Terms of Service

Introduction
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Kennedy Growth Solutions LLC, a Florida limited liability company doing business as Sprinted (“we,” “us,” “Sprinted”), operator of the platform available at sprinted.io. By creating an account, accessing our platform, or using any part of our service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the service.
1. Service Description
Sprinted provides phone number verification services using a combination of AI-assisted analysis and human verification agents. You provide lists of contacts; we return results indicating each contact’s reachability (High Intent, Medium Intent, Low Intent, or Invalid). We verify numbers you upload — we do not source, generate, or sell leads on your behalf.
2. Account Responsibilities
- You must provide accurate, complete, and current information when creating your account.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must not share your credentials with any third party.
- You must be at least 18 years old and have legal authority to enter into these Terms on behalf of yourself or your organization.
- Notify us immediately at support@sprinted.io if you suspect unauthorized access to your account.
3. Acceptable Use
You agree not to use Sprinted to:
- Upload contact lists obtained through illegal means, data breaches, or in violation of any applicable law or third-party terms of service.
- Send unsolicited commercial messages (spam), harassment, robocalls, or any communications that violate applicable law.
- Resell, sublicense, or redistribute our verified output to third parties as a data product or as part of a competing service.
- Reverse-engineer, scrape, or copy our verification methodology, software, or proprietary data signals.
- Overload, impair, or interfere with our systems or infrastructure.
- Violate any applicable local, state, national, or international law or regulation.
You must comply with all applicable telemarketing laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the FTC’s Telemarketing Sales Rule (TSR), and all applicable state telemarketing regulations. We reserve the right to terminate accounts that violate these provisions without prior notice.
4. TCPA Disclaimer
Sprinted provides lead verification only. We verify whether a phone number is likely to be answered — we do not assess, guarantee, or certify whether any specific call, message, or outreach campaign will comply with the Telephone Consumer Protection Act (TCPA) or any other law.
You are solely responsible for ensuring that your calling practices, messaging campaigns, and use of verified data comply with all applicable laws and regulations, including the TCPA, TSR, GDPR, CAN-SPAM, and applicable state laws.
This includes, without limitation, your responsibility to: obtain and document proper consumer consent where required; honor National Do Not Call Registry registrations and internal do-not-call requests; comply with calling time restrictions; and use appropriate disclosures when using automated dialing systems or pre-recorded messages.
Kennedy Growth Solutions LLC expressly disclaims any liability arising from your telemarketing or calling activities.
5. Payment Terms
- Billing: Subscriptions are billed monthly in advance and renew automatically unless cancelled before the renewal date.
- Credits: Each plan includes a monthly credit allowance that resets at the start of each billing cycle. Unused credits do not roll over.
- Payment method: A valid credit or debit card is required. By subscribing, you authorize us to charge your payment method on a recurring basis.
- Pricing changes: We reserve the right to change subscription pricing with at least 30 days’ written notice via email to existing subscribers before any increase takes effect.
- Failed payments: Access may be suspended if payment cannot be collected after Stripe’s standard retry schedule.
- Non-refundable: All subscription fees are non-refundable except as expressly provided in Section 6 (Connect Rate Guarantee).
6. Turnaround & Delivery SLA
Delivery Timeframes
We will deliver verified results within the following number of business days from the clock start defined below:

Business Day Definition
A “business day” is Monday through Friday, excluding the following US federal holidays:
- New Year’s Day (January 1)
- Martin Luther King Jr. Day (third Monday in January)
- Presidents’ Day (third Monday in February)
- Memorial Day (last Monday in May)
- Juneteenth National Independence Day (June 19)
- Independence Day (July 4)
- Labor Day (first Monday in September)
- Columbus Day (second Monday in October)
- Veterans Day (November 11)
- Thanksgiving Day (fourth Thursday in November)
- Christmas Day (December 25)
When a federal holiday falls on a Saturday, the preceding Friday is observed. When it falls on a Sunday, the following Monday is observed.
When the Clock Starts
The SLA clock begins at 12:00 AM Eastern Time on the next business day following your list upload. The day the clock starts is counted as Day 1.
Example 1: You upload Monday at 2:00 PM ET. Day 1 = Tuesday. For a Starter plan (4 business days), delivery is due by Friday 11:59 PM ET.
Example 2: You upload Friday at 6:00 PM ET. Day 1 = Monday (next business day). For a Starter plan (4 business days), delivery is due by Thursday 11:59 PM ET.
Example 3: You upload Monday at 2:00 PM ET and Tuesday is a federal holiday. Day 1 = Wednesday. For a Growth plan (3 business days), delivery is due by Friday 11:59 PM ET.
SLA Credit Policy
If we miss the delivery deadline for reasons within our control (system failures, processing errors, staffing — not including force majeure events, issues caused by malformed uploads, or unusually large lists outside normal parameters), you may request a credit equal to 10% of the credits used on that specific list.
- Credits are applied to your account balance and cannot be exchanged for cash.
- Claim must be submitted within 7 days of the missed deadline.
- Submit claims to support@sprinted.io with your list name and the date of upload.
- This credit is the sole remedy for a missed SLA deadline.
7. Connect Rate Guarantee
This guarantee applies only to your first verified list during your first billing month, subject to all eligibility requirements below.

- You must dial only High Intent leads (Medium and Low Intent leads excluded from calculations).
- You must dial within 30 days of receiving your verified list (data goes stale).
- Calls must be made during business hours: Monday–Friday, 8:00 AM–6:00 PM in the lead’s local timezone.
- You must make a minimum of 2 dial attempts per lead on different days.
- You must dial a minimum of 100 High Intent leads.
- Your caller ID must not be flagged as spam (verifiable via caller reputation tools such as YouMail or First Orion).
- You must use local presence dialing — your displayed caller ID area code must match or be geographically near the recipient’s area code.
Definitions
- A “Connect” means a live human answered the call and the call lasted more than 3 seconds.
- Voicemails, AI screeners, disconnected numbers, and hang-ups within 3 seconds do not count as connects.
- Connect Rate = (Connects ÷ High Intent Leads Dialed) × 100
Required Documentation
- Call logs exported as CSV from your dialer software.
- Logs must include: timestamp, phone number dialed, and outcome per dial attempt.
- Claim must be submitted within 14 days of completing your dials.
Claim Process
- Submit claim to support@sprinted.io with all required documentation.
- We have 14 business days to review and may request additional information.
- Maximum refund cannot exceed fees paid in your first billing month.
Disqualifiers
- Dialing outside business hours (8 AM–6 PM Mon–Fri, local timezone).
- Single-dial attempts only (minimum 2 required on different days).
- Dialing more than 30 days after receiving the verified list.
- Unable to provide call logs in the required CSV format.
- Caller ID flagged as spam at time of dialing.
- Not using local presence dialing.
- Including Medium or Low Intent leads in connect rate calculations.
8. Data Ownership
You retain full ownership of the contact data you upload to Sprinted. We will never sell, share, or provide your uploaded lead lists to any third party. We do not use your uploaded contacts to build competing data products or sell to data brokers.
Aggregate Analytics: We may use anonymized, aggregate patterns derived from verification activity — such as optimal dial times by industry or region — to improve our services. This aggregate data contains no personally identifiable information and cannot be traced back to your specific leads or contacts.
By uploading data to Sprinted, you represent and warrant that you have the legal right to share that data with us and to use it for the purposes described herein.
9. Indemnification
You agree to indemnify, defend, and hold harmless Kennedy Growth Solutions LLC, its members, officers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your uploaded data, including any claim that such data was illegally obtained or infringes third-party rights;
- Your calling practices, telemarketing activities, or any alleged violation of the TCPA or other telemarketing laws;
- Your breach of these Terms or any representation or warranty made herein;
- Your violation of any third-party rights or applicable law.
10. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC CONNECT RATE EXCEPT AS EXPRESSLY STATED IN SECTION 7.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KENNEDY GROWTH SOLUTIONS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE FEES YOU PAID US IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Termination
- By you: Cancel your subscription at any time from your account settings. Access continues until the end of your current billing period. You may also delete your account from Account → Danger Zone, which permanently removes your data.
- By us: We may suspend or terminate your account immediately and without prior notice for violation of these Terms, fraudulent activity, or any conduct we determine poses a risk to our platform or other users.
- Effect of termination: Your right to access the service ceases immediately upon termination. You may download any completed job results prior to account deletion. Sections 4 (TCPA Disclaimer), 8 (Data Ownership), 9 (Indemnification), 10 (Limitation of Liability), and 12 (Dispute Resolution) survive termination.
12. Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Binding Arbitration: Any dispute arising out of or relating to these Terms or your use of Sprinted that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Jacksonville, Florida. Each party shall bear its own attorneys’ fees and costs.
Class Action Waiver: You agree to resolve any dispute with us on an individual basis only. You expressly waive any right to bring or participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding.
Small Claims Exception: Either party may bring an individual action in small claims court in Duval County, Florida if the claim qualifies under applicable rules.
Before initiating arbitration, you agree to contact us at support@sprinted.io and give us 30 days to resolve the dispute informally.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes your acceptance of the updated Terms.
